ESEA Flexibility Application

Indiana is one of only 10 states approved for greater federal flexibility in exchange for challenging but attainable expectations for student growth and performance. In February of 2012, Indiana received approval of a waiver offering flexibility regarding some of the requirements of the No Child Left Behind Act (Elementary and Secondary Education Act as reauthorized in 2001) during the U.S. Department of Education's first review cycle of state waiver applications.

The Indiana Department of Education pursued the waiver to gain several flexibilities for the 2012-2013 school year, including but not limited to the following:

  • federal turnaround restrictions and requirements will be exchanged for state intervention and improvement plans tailored to students' needs;
  • certain highly qualified teacher provisions will be exchanged for more meaningful educator evaluations coupled with targeted professional development;
  • federal accountability guidelines will be balanced with a transparent and objective state-level accountability system that tracks academic growth and performance at the student, school, and district levels; and
  • instead of restrictive federal funding guidelines, Indiana will follow state-level funding policies that support excellence and are student focused.
