HJR 00015 Early Learning Trust Fund

Establishes the early learning trust fund. Transfers the balance of the common school fund to the early learning trust fund. Allows the principal and income of the early learning trust fund to be used only for educational programs for children before entering primary school, including kindergarten. Repeals provisions requiring that all trust funds held by the state remain inviolate and be applied to the purposes for which the trust was created. This proposed amendment has not been previously agreed to by a general assembly.

Allows a student who attends a public school that is found to be in need of improvement to attend a charter school not in need of improvement if the federal Department of Education approves a competition for states to receive matching funds for charter school facility financing. HB 1027 Pledge of Allegiance and Moment of Silence

The bill requires the display of the United States flag in each classroom of a school corporation. The bill also allows a school corporation to provide a daily opportunity for students to voluntarily recite the Pledge of Allegiance, with an exemption for those students who choose (or whose parents choose for them) not to participate in the Pledge. The bill allows a school corporation to establish the daily observance of a 30-second period of silence in each classroom. The bill repeals the law allowing an optional brief period for silent prayer or mediation.

HB 1170 School Corporation Police Department

Provides that the governing body of a school corporation may establish a school corporation police department that is staffed with police officers who have full police powers and whose survivors are eligible for death benefits. Requires school corporation police officers to have law enforcement academy education and pre-basic and basic training and to participate in local continuing education programs. Requires a school corporation police officer who was appointed before July 1, 2005, to complete the law enforcement academy education and basic training requirements not later than July 1, 2008. Imposes deadlines for school corporation police officers to commence law enforcement academy education and basic training requirements. Requires a school corporation to notify the appropriate law enforcement agency if a person commits battery or a related offense against a school corporation employee on school corporation property or at a school event. Provides that a school corporation police department established before July 1, 2005, is considered a school corporation police department established under this act after June 30, 2005.

HB 1198 Student Suspensions and Expulsions

Requires schools to report the reasons for student suspensions and expulsions to the Department of Education. Authorizes an agreement for court assisted resolution of suspension and expulsion cases between a court having juvenile jurisdiction and a school corporation. Provides that the court shall either supervise the student or order the supervision of the student. Provides that the court and the school corporation may jointly determine which violations leading to suspension or expulsion are eligible for referral to the court. Provides that the school corporation and the court shall determine how the costs of supervising a student under the agreement shall be paid. Allows the school corporation to disclose the education records of a student who has been suspended or expelled to a court. Provides that (1)a student's appearance in court shall not be used against the student, the student's parent, or guardian in any subsequent court proceeding, (2) all records of a student's court appearance shall be expunged upon the student's completion of the court assisted resolution of suspension and expulsion program, and (3) a parent , guardian, or legal counsel has the right to be present during the student's court appearance.

HB 1385 High School Diplomas and Benefits for Veterans

Provides a $150,000 death benefit for a member of the national guard or a reserve component who dies while on military duty outside the United States beginning September 11, 2001. Appropriates an amount sufficient for the death benefit. Establishes the veterans' affairs trust fund to finance certain benefits and services to eligible veterans and to fund veteran related projects authorized by the veterans' affairs commission. Funds the trust fund by: (1) taxpayer designation of all or part of a state income tax refund; (2) a quarterly allocation of 0.5% of the surplus revenue in the administrative trust fund; (3) donations; and (4) appropriations or other amounts provided for the fund. Provides that benefits available to eligible veterans from the fund include: (1) tuition reimbursement; (2) temporary emergency aid grants for subsistence and health care; (3) personal loans; (4) an assistance program for veterans in need of services; (5) retraining grants; (6) allocations to the state armory board for use by the military department ceremonial unit in rendering appropriate military honors at state functions and veteran funeral services; (7) grants to veterans' associations, veterans' organizations, and memorial corporations; and (8) grants to county service officers to improve services to veterans. Requires the department of veteran's affairs to establish a program to reimburse a resident medal of honor award for participating in patriotic and other official events. Appropriates an amount sufficient to reimburse medal of honor awardees. Provides that a veteran of the Korean Conflict who left a public or nonpublic high school without graduating in order to perform military service is entitled to receive a high school diploma.

Provides that if the governing body of a school corporation has not established a policy concerning the Pledge or a period of silence, a principal or teacher may establish a policy. Requires the attorney general to defend suits challenging the constitutionality of the matters covered in this bill. Repeals a law allowing an optional brief period of silent prayer or meditation.
