This guidance is prepared by the Divisions of Educational Options and School
Traffic Safety and Emergency Planning concerning House Enrolled Act 1006 on homeless
student transportation
HEA 1006 (Public Law No. 191-2006) creates a new chapter
in the school transportation code on "Transportation of Homeless Students." The Act allows homeless
students to be transported by a special purpose bus or an "appropriate vehicle
owned by the school corporation." The Act does not define "appropriate
vehicle owned by the school corporation."
An "appropriate vehicle owned by the school corporation"
is an automobile or car, not including a van of any
capacity rating. Student transportation in a van is
prohibited by P.L. No. 278-2001, section 10 beginning
July 1, 2006.
An operator of the "appropriate vehicle owned by the school corporation" must
possess a valid driver’s license of any type.
An annual driving history report is recommended.
A criminal history report is required. Refer to I.C. 20-26-5-10.
All vehicle passengers must properly use the vehicle restraint systems, including
child restraint seats or booster seats as appropriate. Refer to I.C. 9-19-10
et seq. and 9-19-11 et seq.
In considering transportation services for homeless students, it is important
to acknowledge that homelessness alone is not sufficient reason to separate students
from the mainstream school environment. School districts must adopt practices
to ensure that students are not segregated or stigmatized on the basis of their
homeless status. Practices can include, but are not limited to, drop-off and
pick-up sites other than at the shelter or picking up homeless students first
and dropping them off last.
