Are children that have been removed from the home by CPS and are wards of the court (and living in a shelter until foster care placement can occur) considered homeless? Their parents are not homeless. |

Yes, those children would be considered homeless, even though their parents are not. The McKinney-Vento Act covers children "awaiting foster care placement." The children this refers to are sometimes in shelters if one is available, but may also be placed in emergency or respite foster homes. |

No, please submit only students that were (1) homeless, (2) served by gifted & talented (high ability) programming, or (3) had a shortened instructional day for at least half of the school year. See the data layout for more specifics. |

The AD report states one record per student giving priority to the flex program, but does not state what precedence should be given if a student is on shortened day due to medical and then due to family obligations.

We ask for this data by the end of the year, so if a student is on medical leave by the end of the year report medical as the "final" reason for shortened day.

Who would “McKinney-Vento Homeless liaison” be? |

Each individual school corporation has the right and responsibility to designate who the McKinney-Vento Liaison is. We go with whatever the superintendent decides with one exception- the liaison cannot be the superintendent. Other appropriate staff would include the director of student services, counselors, social workers, attendance officers, home school advisors, occasionally nurses…the best choice is someone in the corporation with community services knowledge, direct interaction with students, but preferably someone who is not a classroom teacher (it’s too hard a position for them to juggle- other positions that are more administrative can incorporate it into their responsibilities more easily). We really prefer not to mandate who the liaison is because each school corporation will have a better idea of who can do the job based on the size or structure of their corporation. All of the above would apply to the school leader in the case of a charter school.

I submitted my AD report and got a few errors as we have 6 students that are homebound students with IEP's that are not attending school at all but are receiving services from us. We submitted these students as missing 430 minutes and therefore we got an error because the maximum we could use was 300 minutes. Am I supposed to include these students on this report, and if so do I just use 300 minutes and say that they are receiving instruction for the remainder of the day, or do I not include them at all? |

Only students whose IEP is less than a full day of instruction, please provide the average for 1 week. Example: the elementary student (300 minutes a day) receives instruction for 1 hr a week. The average for 1 week is 288 minutes lost. Field Removed in 07/08 Collection

If a family’s house burns down and they have to stay with relatives for awhile would we use Code D for disaster or is that just for Katrina victims? The layout says “such as”. Also if the Board of Health request that the family moves out for a couple of weeks until its conditions are deemed livable are they considered “homeless” for that period of time? |

A Code D was used to help us identify Katrina victims that came to our state. Families that are homeless because of other disasters should be coded as Yes. You will be notified when to use Code D again, hopefully never. |

Where can I find more information about a school flex instructional program? |

School flex instructional program
Sec. 2.2. (a) As used in this section, "eligible student" means a student in grade 11 or 12 who has:
(1) failed the ISTEP+ graduation exam at least twice;
(2) been determined to be chronically absent, by missing more than ten (10) unexcused days of school in one (1) school year;
(3) been determined to be a habitual truant, as identified under IC 20-33-2-11;
(4) been significantly behind in credits for graduation, as identified by an individual's school principal;
(5) previously undergone at least a second suspension from school for the school year under IC 20-33-8-14 or IC 20-33-8-15;
(6) previously undergone an expulsion from school under IC 20-33-8-14, IC 20-33-8-15, or IC 20-33-8-16; or
(7) been determined by the individual's principal and the individual's parent or guardian to benefit by participating in the school flex program.
(b) An eligible student who participates in a school flex program must:
(1) attend school for at least three (3) hours of instructional time per school day; (2) pursue a timely graduation;
(3) provide evidence of college or technical career education enrollment and attendance or proof of employment and labor that is aligned with the student's career academic sequence under rules established by the Indiana bureau of child labor;
(4) not be suspended or expelled while participating in a school flex program;
(5) pursue course and credit requirements for a general diploma; and
(6) maintain a ninety-five percent (95%) attendance rate.
(c) A school may allow an eligible student in grade 11 or 12 to complete an instructional day that consists of three (3) hours of instructional time if the student participates in the school flex program.
(d) If one (1) or more students participate in a school flex program, the principal shall, on forms provided by the department, submit a yearly report to the department of student participation and graduation rates of students who participate in the school flex program.
